EVENT PARTICIPATION WAIVER AND RELEASE OF LIABILITY

1. ASSUMPTION OF RISK

By entering The Woods and participating in any activity or event, including but not limited to pickleball, beach volleyball, roller skating, dancing, live entertainment, inflatable attractions, bounce houses, obstacle courses, slides, amusement-style equipment, and other recreational or social activities, I acknowledge and agree that I am voluntarily participating at my own risk.

I understand that these activities involve inherent and potential risks, including but not limited to slips, falls, collisions, impacts, equipment failure, dehydration, sun exposure, physical exertion, property damage, and serious injury. I acknowledge that these risks may arise from my own actions, the actions of others, environmental conditions, or the condition or use of equipment.

I freely and knowingly assume all risks, known and unknown, foreseeable or unforeseeable, even those arising from the ordinary negligence of Woods Projects, LLC, its owners, officers, employees, agents, contractors, vendors, volunteers, or affiliates (collectively, “The Woods”), to the fullest extent permitted by Florida law.

2. INFLATABLE ATTRACTIONS AND SAFETY COMPLIANCE

I acknowledge that inflatable attractions and amusement-style equipment involve heightened physical activity and risk. I agree to follow all posted rules, verbal instructions, safety guidelines, age restrictions, height or weight limits, footwear requirements, and staff directions at all times.

I affirm that I am physically capable of participating and do not have any medical condition that would make participation unsafe. I understand that failure to comply with safety rules may result in immediate removal from the activity or premises without refund.

3. MINORS AND PARENT OR LEGAL GUARDIAN CONSENT

If the participant is under the age of 18, I represent and warrant that I am the parent or legal guardian of the minor participant. I consent to the minor’s participation and expressly agree to this waiver and release on behalf of the minor and myself.

I knowingly and voluntarily waive, release, and discharge any and all claims or causes of action on behalf of the minor and myself against The Woods, including claims arising from the ordinary negligence of The Woods, to the fullest extent permitted by law.

4. ALCOHOL AND CONDUCT

I acknowledge that alcohol may be available at certain events. I agree to consume alcohol responsibly and in compliance with all applicable laws regarding age, conduct, and behavior.

I accept full responsibility for my actions, behavior, safety, and any injury or property damage resulting from alcohol consumption. The Woods reserves the right to refuse service or remove any individual from the premises for unsafe, disruptive, or unlawful behavior at its sole discretion.

5. RELEASE OF LIABILITY

In consideration for being permitted to enter The Woods and participate in any activity or event, I hereby release, waive, discharge, and covenant not to sue Woods Projects, LLC, and all associated parties from any and all claims, demands, damages, losses, injuries, or causes of action, whether to person or property, arising out of or related to my or the minor’s participation or presence on the premises.

This release includes, but is not limited to, claims for personal injury, illness, death, theft, property loss, or damage caused by the acts or omissions, including ordinary negligence, of The Woods or any other participant, to the fullest extent allowed by Florida law.

6. PROPERTY DAMAGE

I agree to be personally responsible for any damage I cause to The Woods’ property, equipment, or facilities, whether intentional or accidental, and I authorize The Woods to charge me for reasonable repair or replacement costs.

7. MEDICAL TREATMENT

I consent to receive emergency medical treatment deemed necessary in the event of injury, accident, or illness during the event. I release The Woods and its personnel from any liability arising from such medical treatment or the decision to seek or not seek treatment.

8. PHOTO AND MEDIA RELEASE

I understand that photographs, video, or audio recordings may be taken during the event. By attending, I grant The Woods the irrevocable right to use my and/or the minor’s image, likeness, or voice for promotional, marketing, or documentation purposes without compensation.

9. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless The Woods from any claims, liabilities, damages, losses, or expenses, including reasonable attorney’s fees, arising out of or related to my or the minor’s participation, attendance, conduct, or violation of this agreement.

10. ACKNOWLEDGMENT OF RULES AND REMOVAL

I agree to comply with all posted rules and staff instructions. Failure to do so may result in immediate removal from the premises or activities without refund.

11. BINDING EFFECT AND SEVERABILITY

This agreement shall be binding upon me, the minor participant (if applicable), and our respective heirs, executors, administrators, and assigns. If any portion of this agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12. ACKNOWLEDGMENT AND SIGNATURE

I acknowledge that I have read and fully understand this agreement. I understand that by signing, I am giving up substantial legal rights, including the right to sue. I sign this agreement voluntarily and without inducement.
